“WINNIPEG FREEZE” TICKET USE TERMS AND DISCLAIMER:
WARNING: DESPITE SPECTATOR SHIELDING MEASURES, SERIOUS INJURIES CAN RESULT FROM OBJECTS (INCLUDING WITHOUT LIMITATION PUCKS, STICKS AND OTHER EQUIPMENT) PROJECTED, THROWN OR HIT INTO THE SPECTATOR AREA IN CONNECTION WITH THE EVENT FOR WHICH The TICKET IS ISSUED (THE “EVENT“). STAY ALERT AT ALL TIMES INCLUDING DURING WARMUP AND AFTER PLAY STOPS. IF STRUCK, IMMEDIATELY ASK USHER FOR DIRECTIONS TO MEDICAL STATION.
The holder of a ticket (“Holder”) is admitted to the Event on condition that the Holder by use of this ticket agrees to the following:
The Dakota Community Centre Inc (the “Arena“) is a strictly enforced smoke-free environment.
Admission to the Event is subject to compliance with applicable laws, by-laws, regulations and Arena rules in place from time to time (the “Rules“).
Prohibited items at the Event include but are not limited to bottles, coolers, bags, containers, air horns, alcoholic beverages, illegal drugs, food products, weapons, professional cameras and all forms of recording or transmitting devices. Prohibited items are not allowed in the Arena and may be confiscated. Holder consents to a reasonable examination of the Holder’s person and property to ensure compliance with the Rules. If the Holder elects not to consent to such examination, the Holder may be denied entry to the Event without refund or other compensation.
Winnipeg Freeze, The Dakota Community Centre Inc, Manitoba Junior Hockey League (“MJHL“) and Arena personnel reserve the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct their personnel deems disorderly, who uses vulgar or abusive language or who fails to comply with the Rules.
Winnipeg Freeze, The Dakota Community Centre Inc, MJHL, and MJHL member clubs are not responsible for the conditions or the actions of the crowd at any Event or for any changes made at the Arena including without limitation seating arrangements, or venue conditions.
Tickets obtained from unauthorized sources, and tickets lost by another Holder, stolen or counterfeited will not be honoured.
Unlawful resale (or attempted resale), counterfeit or copy of tickets are grounds for seizure and cancellation of the Holder’s ticket without compensation. Holder is responsible for complying with all applicable ticket resale laws.
No ticket refunds or exchanges.
Ticket cannot be replaced if lost, stolen or destroyed. Ticket is a revocable license which may be withdrawn and admission refused at any time without cause upon refunding Holder the printed purchase price. The license granted by ticket will automatically terminate without compensation to the Holder if any Rule or term hereof is breached.
Holder acknowledges and assumes all risks related in any way to the Event (including, without limitation, risks of personal injury, property loss and/or damage), arising or resulting from any cause whatsoever (including, without limitation, any acts or omissions by players, coaches, hockey operations personnel, arena or event personnel, spectators, and other inherent risks incidental to the event including without limitation from negligence) and whether occurring prior to, during or after the event. Holder agrees that Winnipeg Freeze, The Dakota Community Centre Inc, MJHL, MJHL member clubs and current and former players, and each of their affiliates, parents, related entities, owners, governors, officers, directors, partners, partnerships, principals, employees and agents are expressly released and forever discharged by Holder from any and all claims arising from or relating to such risks or otherwise occurring at or in connection with the Event.
Holder agrees to abide by MJHL and MJHL member club policies and will not make any commercial or other unauthorized use of any MJHL or MJHL member club name, mark or logo.
Ticket may not be used for advertising, promotion (including contests and sweepstakes) or other commercial purposes without prior written consent of MJHL. Holder further agrees to abide by policies of Winnipeg Freeze, The Dakota Community Centre Inc, MJHL member clubs, the Arena and the instructions of Arena personnel or shall be subject to revocation of the license created by Ticket without refund and/or ejection from the Event. Any non-editorial or commercial use of any MJHL or MJHL member club mark is prohibited without prior written approval of MJHL and such MJHL member club. Any unauthorized transmission, picture or other depiction or description of any game action, game information or other arena activity is prohibited without prior written approval of MJHL and Winnipeg Freeze.
Holder agrees that the Event is a public event, that the Holder’s appearance and actions inside and outside the Arena are public in nature, and that the Holder has no expectation of privacy with regard to Holder’s actions or conduct at the Event. Holder grants permission to Winnipeg Freeze, The Dakota Community Centre Inc, MJHL, MJHL member clubs, and Arena personnel to utilize Holder’s name, image, likeness, acts, poses, plays, appearance, movements, and statements in any live or recorded audio, video, or photographic display or other transmission, exhibition, publication or reproduction made of, or at, the event (regardless of whether before, during or after play or performance) for any purpose, in any manner, in any medium or context now known or hereafter developed, without further authorization from, or compensation to, the Holder or anyone acting on the Holder’s behalf.
COVID-19 WARNING:
An inherent risk of exposure to COVID-19 exists in any place where people gather. COVID-19 is an extremely contagious disease that can lead to severe illness and death. Holder assume all risks, hazards, and dangers arising from or relating in any way to the risk of contracting COVID-19 or any other communicable disease or illness, or a bacteria, virus or other pathogen capable of causing a communicable disease or illness, whether occurring before, during, or after the event, however caused or contracted, and voluntarily waive all claims and potential claims against Winnipeg Freeze, The Dakota Community Centre Inc, MJHL, and MJHL member clubs, and their directors, officers, employees, volunteers and affiliated companies relating to such risks.
